THE $995.00
WEB SITE "FINE PRINT"...
This is essentially
the agreement which will be sent to you for your approval:
- Explanation of Terms: Throughout this agreement the words "you"
and "your" refer to you and/or your company, and the
words "we", "us" and "our" refer
to Bitterolf Marketing.
- Domain Name: We will search for the availability of
the domain name(s) of your choice (ending in .COM, .ORG or .NET),
and register in on your behalf and in your name if available.
Should your name choice(s) not be available, then we will suggest
available alternatives to you. We will pay for the initial
one-year registration of one name, and you will be responsible
for registration payments for subsequent years (currently $15.00
per name per year).
- Hosting: We will contract hosting service with
a service provider of our choice and pay for the first 12
months of hosting. Currently we are offering 15MB HD space,
4 e-mail boxes, and 1500 MB transfer for our $995.00 packages.
This is a lot more than most small and medium business sites
will ever use. You will be responsible for subsequent hosting charges (currently $15.00/month)
- Web Site Creation: We will create a web site with one home
page and typically two linked pages. The package price of $995.00
includes using up to 12 graphic elements based on scan ready
material sent by you, stock art, stock photography or graphic
elements designed by us.
- Text: We prefer if you e-mail or floppy-mail us the
text you want to use in your site - this will ensure the accuracy
of your copy and technical expressions unique to your business.
Unformatted TXT text files are by far the best, RTF files are
second choice. Check with us if you are not sure about the formats
you can make available. If necessary we will do a reasonable
amount of typing (up to 1000 words in plain English).
- Tables: One table e-mailed or floppy-mailed in
spreadsheet format (Excell or Lotus WK1 format preferred) up
to 300 fields is included in your $995.00 package. We will type
one table of up to 25 fields without additional charge.
- Images: The price includes the processing of a total of
12 static images (logos, photos, illustrations, drawings, paintings,
graphs, or any other static pictorial material that you supply to us
on paper ready to scan (maximum size for scanning is 8 1/2 "x 11").
Digital images and drawings are welcome in TIFF, JPG, GIF and some other
formats - please check with us. We work in a Windows environment; there
may be additional charges if we have to convert images from Macintosh
and/or from some other less common image formats.
The $995.00 package includes scanning,
cropping and optimization of the images for internet use, but
does NOT include retouching or masking. We will notify you if
the material you send to us needs additional work.
- Production Process: We will produce the pages in a style
we think you will like (based on your logo, brochures, stationery,
etc.), and submit a provisional home page for your approval on
a hidden site to which you will have access. Once this home page
is approved we will proceed to produce the linked pages. You
can monitor the progress of your pages all along on the hidden
site. We will notify you when we think it is finished and upload
it once you have given it final approval.
- Additional Charges: Additional charges can occur if the material
you submit or the demands you are making are not within the above
specifications. You will be asked for your authorization BEFORE
any such charges are incurred.
There WILL be additional charges
if you want to add more domain names, pages, images or other
features not included in the basic $995.00 package. You will
be given a price quotation for your approval before we will proceed
with such additional work.
- Copyright Issues: You MUST SIGN ALL PHOTOS,
ILLUSTRATIONS, ARTWORK AND OTHER GRAPHIC MATERIAL SENT TO US
and include a statement that you have the copyright to it. Under
no circumstances can we be held liable for copyright violations.
- Disclaimer of liabilities: Our liability on any issue related to
your web pages is limited to making the relevant corrections
on the site. The graphic and text content of the site is originated
by you, and/or based on information obtained from you, and authorized
for publication by you. We can not assume any responsibility
for its content in any way whatsoever.
- Payments and Terms: We will issue a partial invoice for
50% ($497.50) upon receiving your go-ahead, and start work as
soon as payment is received. The balance of 50% ($497.50) will
be invoiced and is due as soon as the site is on line.
- Cancellation of Agreement:
Should the agreement
be canceled by you, your initial payment of $497.50 will not
be refunded, but you will retain possession of your domain
name (it will have been paid by us for 1 year) and you will
have access to
the hosting service for one year (also already paid for by us).
- Changing of Terms: We reserve the right to change
any or all the terms outlined above at any time and without notice.
The terms in effect of receipt of order will be honored until
the order has been completed.
- Effective Date: January 1, 2007
